Affiliate Agreement
This Affiliate Agreement (“Agreement”) is entered into by and between Platysens (“Platysens”) and the affiliate (“Affiliate”), collectively referred to as the “Parties”, effective as of the date of Affiliate’s acceptance of this Agreement.
1. Definitions
1.1 “Affiliate” refers to the individual or entity participating in Platysens’ affiliate program by promoting Platysens products or services.
1.2 “Platysens Products” refers to any products or services offered by Platysens.
1.3 “Commission” refers to the compensation paid to the Affiliate for qualified sales or referrals generated through the Affiliate’s promotional efforts.
2. Enrollment in Affiliate Program
2.1 Affiliate shall apply for enrollment in Platysens’ affiliate program through the designated application process.
2.2 Platysens reserves the right to accept or reject any affiliate application at its sole discretion.
2.3 Upon acceptance into the affiliate program, Affiliate shall be provided with unique tracking links or referral codes to track referrals and sales.
3. Affiliate Responsibilities
3.1 Affiliate shall promote Platysens Products in a professional manner and in compliance with all applicable laws and regulations.
3.2 Affiliate shall not engage in any deceptive, misleading, or unethical marketing practices.
3.3 Affiliate shall be solely responsible for any content posted or distributed in connection with the promotion of Platysens Products.
4. Commission Structure
4.1 Platysens shall pay Affiliate a commission on qualified sales or referrals generated through Affiliate’s unique tracking links or referral codes.
4.2 Commission rates are 15% and payment terms shall be specified in a separate commission schedule or agreement.
4.3 Platysens reserves the right to modify commission rates and payment terms at any time upon notice to Affiliate.
5. Tracking and Reporting
5.1 Platysens shall track referrals and sales generated through Affiliate’s unique tracking links or referral codes.
5.2 Affiliate shall have access to reporting tools to monitor referral and sales activity.
6. Payment
6.1 Platysens shall pay Affiliate commissions in accordance with the payment terms specified in the commission schedule or agreement.
6.2 Payment shall be made via PayPal
7. Termination
7.1 Either Party may terminate this Agreement at any time for any reason upon written notice to the other Party.
7.2 Upon termination, Affiliate shall immediately cease all promotion of Platysens Products and remove all links or referral codes.
8. Confidentiality
8.1 Affiliate shall maintain the confidentiality of any proprietary or confidential information disclosed by Platysens.
8.2 Affiliate shall not disclose such information to any third party without the prior written consent of Platysens.
9. Governing Law
9.1 This Agreement shall be governed by and construed in accordance with the laws of New Zealand.
10. Entire Agreement
10.1 This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
By accepting this Agreement, Affiliate acknowledges that they have read, understood, and agree to be bound by its terms and conditions.
